All purchases made through the My SunglassBoutique by Lammerant webshop are governed by the general terms and conditions stated below. When the purchaser places an order, he or she declares that he or she is adequately familiar with the general terms and conditions and expressly accepts them.
The purchaser’s terms and conditions to the contrary shall not be accepted unless Optiek Lammerant has expressly accepted them in advance and in writing.

Orders to purchase glasses and sunglasses can be placed through the Optiek Lammerant webshop. Every product is presented through the webshop by means of a picture and an accompanying product description. Any technical details available regarding the product and the size of the glasses will also be mentioned.

The purchase agreement is formed after Optiek Lammerant has accepted the order. This normally happens within seconds after payment. Optiek Lammerant will let the purchaser know as soon as possible the order cannot be executed because the item is not in stock. Out of stock items will be labbeled in the webshop. In such case, the purchaser cannot claim any form of compensation for damages.
The validity period is expressly stated if promotions or special offers having a limited validity period are offered in the webshop.
All prices (in euros) that are stated in the webshop always exclude VAT and any taxes are at the purchaser’s expense. Additional costs for transport, freight, reservation and delivery, as well as the administrative costs, are charged separately.
The price stated refers exclusively to the items as these are literally described. The accompanying photograph serves as an example but can contain elements or items not included in the price.
My SunglassBoutique / Optiek Lammerant accepts the following payment methods for orders placed in the webshop:
Optiek Lammerant uses the Mollie payment system to guarantee safe payment. An order confirmation of the purchase is sent to the purchaser and the purchase agreement is definitively concluded from the moment that we receive the payment.
The product remains the property of My SunglassBoutique / Optiek Lammerant until the total price of the product ordered has been paid.
My SunglassBoutique / Optiek Lammerant undertakes to send the purchased products to the purchaser within a period of 30 working days, to be counted as from the day on which Optiek Lammerant accepts the order by means of the order confirmation.
The purchaser receives a dispatch notification the moment that the purchased products are sent. All dispatches, both national and international, are sent through bpost.
During the settlement process the purchaser can tick off one of the following options regarding how he or she wants the packet to be sent:
The purchaser can follow his or her order on line by typing the track and trace code stated in the dispatch notification in the bpost e-tracking system.
The purchaser has the right to withdraw from the purchase of his or her product without giving any reasons whatsoever within a period of 14 calendar days after delivery, i.e. the day on which the purchaser or a third person designated by the purchaser, other than the transporter, physically receives the object in his or her possession.
The purchaser must notify My SunglassBoutique / Optiek Lammerant in writing of the fact that he or she wishes to withdraw from his or her purchase. The electronic withdrawal form, which is to be found on the website, can be used for this purpose. This is stated on the order confirmation. The validity of the withdrawal is confirmed to the purchaser as soon as Optiek Lammerant receives said withdrawal.
The purchaser must return the product to Optiek Lammerant at the following address through bpost or hand it in at the Optiek Lammerant street shop without delay but, in any event, no later than within 14 calendar days after the day on which he or she notified Optiek Lammerant of his or her decision to withdraw from the agreement:

Optiek Lammerant shall refund the purchase price paid if the purchaser uses this right of withdrawal. The payment shall be refunded by the same means of payment as the purchaser used to make the payment.
The purchaser shall be liable for the costs accompanying the return of the products. If the returned products are damaged or have devalued, My SunglassBoutique / Optiek Lammerant reserves the right to hold the purchaser liable and to claim compensation for damages for any damage or devaluation attributable to the purchaser.
Only products in their original packaging and accompanied by all the accessories and appurtenances, as well as by the invoice or the proof of purchase shall be taken back. The following shall not be taken back under any circumstance:
The purchaser is entitled to a 2-year guarantee on factory defects of purchased products. Other damage or theft of the purchased products do not fall within the purchased guarantee.
The guarantee period starts running as from the date on which the product is delivered.
If products are purchased in the Optiek Lammerant webshop, the following free after-sales services shall be offered:
Any complaints regarding visible defects or conformity defects that there were when the product or products was or were delivered, which the purchaser was reasonably able to establish after checking them must be reported to My SunglassBoutique / Optiek Lammerant in writing no later than within 48 hours after delivery.
The following shall not be regarded as conformity or visible defects: slight differences and deviations in the colour of glasses and sunglasses compared to the image shown in the webshop.
Any complaints relating to hidden defects must be reported to My SunglassBoutique / Optiek Lammerant at sh[email protected] or in writing at the shop address (Gaversesteenweg 44, 9800 Deinze) no later than within 8 days after the defect(s) was (were) discovered.
The processing controller, Optiek Lammerant, duly respects the Belgian Law of 8 December 1992 on the protection of privacy in relation to the processing of personal data.
The personal data communicated by the purchaser shall only be used for the following purposes:
The purchaser has a statutory right to peruse and perhaps correct his or her personal data. On condition that he or she submits proof of identity (copy of identity card), the purchaser can, by means of a written, dated and signed request addressed to Optiek Lammerant, be notified in writing of his or her personal data. If necessary, the purchaser can also request that the data that are incorrect, incomplete or not pertinent, be corrected.
If the data are used for direct marketing purposes, the purchaser can object, free of charge, to having his or her data used for direct marketing. To this end, the purchaser can address Optiek Lammerant at [email protected] or in writing at the shop address (Gaversesteenweg 44, 9800 Deinze BE).
Optiek Lammerant treats the purchaser’s data as confidential information and shall not pass on the data, hire it or sell it to third persons. We only pass your name and address on to third persons to ensure that the product is delivered to you (for example, to our courier or supplier).
The purchaser is personally responsible for keeping his or her login details confidential and for the use of his or her password. The purchaser’s password is coded and stored; therefore, Optiek Lammerant does not have any access to your password.
Optiek Lammerant keeps an (anonymous) online record of visitors’ statistics to be able to see how many times people visit which pages of the website.

Belgian law applies to the orders and purchases that are made in the My SunglassBoutique / Optiek Lammerant webshop.
Only the Courts of East Flanders, Division of Ghent, are competent to judge disputes that have arisen from or are pursuant to the execution of the purchase agreement.
The nullity of a provision or part thereof does not bring about the nullity of all the other provisions contained in these General Terms and Conditions of Sale.
